The following terms and conditions apply to all transactions with Learning SPACE.
1. Description
Colours and styles may vary. Whilst we take every care to ensure illustrations and descriptions within the catalogue and website are accurate, we reserve the right to change specifications or improve our products. In the event of any substituted product not being acceptable, we will gladly issue a full refund, provided the goods in question are returned within 28 working days of delivery and in an 'as new' re-saleable condition. Prior authorisation is required see 15.2
2. Availability
If an item is out of stock, we will inform you and endeavor to supply the item or an alternative as soon as possible. Goods in the catalogue and on the website are subject to availability. On occasion goods will be discontinued for reasons beyond our control. We reserve the right to withdraw an item where a print error has occurred.
3. Prices
We aim to keep all prices fixed until 31.12.2010 (errors and omissions excepted), however, exceptionally volatile raw material costs may affect some products this year. You will be advised prior to dispatch of any increases.
4.Value Added Tax
Prices are quoted in our catalogue in sterling, exclusive of VAT and inclusive of VAT. Online prices are inclusive of VAT, to receive a VAT receipt select ‘VAT receipt’ when checking out online. VAT shall be charged on invoices at the rate in force. Your tax status shall be a matter between you and the appropriate tax authority. For invoicing purposes we may require you to provide evidence of exemption from VAT.
5. Payments
We accept payment by major credit cards. Otherwise, cheques should be made payable to "LearningSPACE" or contact our Accounts Department for details of BACS payments. When making payments online feel confident in shopping securely with PayPal. If you don’t have a PayPal account don’t worry you can still pay securely by clicking the “don’t have a PayPal account” option. For non-invoice account holders items will only be despatched when full payment has been received, not when you place your order.
6. Educators Discount Card
When you spend £20 or more, apply online or in store to get a unique code for 10% discount! Please note 10% is not available on selected items marked with a *.
7. Paying on Account
When you want to place an order online using an account, simply click on the ‘order on account’ button and follow the instructions. Items will be dispatched once verified and a Learning SPACE account is approved. This enables your establishment to 10% when you spend £20 or more, free postage when you spend £50 or more and 30 days credit. Please note 10% is not available on selected items marked with a *.
Invoice will be sent when items are all dispatched. Delivery address must be a school/childcare establishment. Named person must be authorised by the school/childcare establishment to buy on their behalf.
When you want to place an order using your standard requisition form or Learning SPACE form simply use the website, catalogue or store to choose items. To avail of the discount quote your LS account number or contact us to set up an account. (Northern Ireland Educational boards automatically have accounts set up and the discount will apply)
In store
Choose what you would like in store. We will reserve them and send a wish list to your organisation. Once we receive an official order from your organisation items will be dispatched. (Items can only be held for 30days)
If your organisation would like to select items from our Belfast store and take on day then a prior phone call is needed by an authorised buyer. An authorisation in store buying code (which can take up to 3 days due to security checks) will be given once verified. Items can be chosen on the day and an invoice sent to the organisation. ID must be brought in store.
Account holders can make immediate payments. We reserve the right to charge interest on all overdue accounts at 2% per month on the outstanding balance. We may consult a credit reference agency. Invoice accounts apply to UK and Republic of Ireland customers only.
8. Title of Goods
Ownership (title) of the goods only passes to you on full payment of the appropriate invoice.
9. Passing of Property
The risk in the goods supplied shall pass to you on delivery into your possession or to the carrier or place of delivery nominated by you. LearningSPACE shall be under no liability whatsoever for any loss or damage occurring thereafter.
10. Delivery
(10.1) Postage costs are £6 per delivery and for Invoice orders see 7.
(10.2) Ordering from outside the UK and Ireland postage is subject to quotation. Please place your order and we will contact you with the delivery cost if it is greater than £6. We will endeavour to get the cheapest quote. If the quote is not suitable full refund will be given.
(10.3) All products are sent by courier or Royal Mail.
(10.4) For express delivery contact us for costs and availability.
(10.5) You bear the risk once the products have been received signed for/delivered.
(10.6) LearningSPACE accepts no liability for any loss, damages or expenses arising from the late delivery of goods by us, our agents or our agents’ carriers due to any cause whatsoever. Any delivery time or date for dispatch or delivery date which we may specify is accordingly a best estimate only and should not be relied upon. We will however, seek to achieve delivery dates specified as far as it is within our power to do so. It is our policy to try to fulfill standard delivery orders within seven working days and if you specify a certain day we will aim to deliver by that named day.
11. Notice of Damage / Incorrect Delivery / Missing Orders
(11.1) When requested deliveries must be signed for. Ensure the correct box quantity is stated and record any box damages or discrepancies.
(11.2) Ensure that all parcels are unpacked and checked carefully upon receipt and that our Customer Services Department is notified of any errors or damages within 5 days of receipt. Each box will be numbered and have an itemized delivery note/invoice. Please quote box number of any discrepancies.
(11.3) Notification of non-delivery of goods should be made within 5 days of the invoice date. Claims outside this period will not be accepted.
(11.4) Do not attempt to return any goods without prior authorisation and a relevant reference number.
12. Proof of Delivery
A signed proof of delivery document will be available from LearningSPACE for a period of 90 days from date on invoice. After this period, LearningSPACE may refuse such request for proof of delivery or impose a charge for its supply. In any event after this period you shall be liable for payment of monies due in respect of the goods supplied.
13. Refused Delivery
We reserve the right to make a carriage charge plus a 20% handling charge, or minimum of £10 whichever is greater, on all consignments that are refused without reason.
14. Cancellation of Orders
You have the right to cancel your contract with us at any time before the date of delivery of the products. You will receive a full refund of the purchase price and the delivery charge. If items have been dispatched you will incur any delivery costs.
15. Returns
(15.1) In the unlikely event that a product is faulty we are happy to exchange or refund merchandise if we are notified via email or phone within 28days of purchase, provided a valid learning SPACE returns reference is given. Simply contact us via: Email*** info@learningspaceni.co.uk, or phone, 02890319360 and you will be given a reference number. We will arrange the return of the goods at no cost to the buyer. In the event we find no fault, we reserve the right to re-charge you for the item/s and to recover our fees and expenses from you.
(15.2) We are happy to exchange or refund, unwanted / items ordered in error, if they are returned within 28days of purchase, provided the goods are unused, in a re-saleable condition, in original packaging and a returns reference is given. If there has been an error on our part we will arrange the return of the goods at no cost to the buyer. If there has been no error on our part, under our returns policy we will refund only the cost of the item/s. We will not refund the cost of delivery. Please ensure items are adequately insured during the return journey and you use recorded delivery.
(15.3) Do not attempt to return any goods without prior authorisation and a relevant reference number.
(15.4) Refunds may take up to 30 days from the date the returned item is received by us.
(15.5) If you are able to return the merchandise in store please return within 28days of purchase and provide a returns reference. ***When contacting us via email we will respond within 48 hours. If you do not receive a response within 48 hours there may be a communication fault and it would be advisable to resend or make contact via the phone.
16 Age Suitability
(16.1) All Products are unsuitable for children under 3 unless otherwise stated.
(16.2) All age recommendations and suitability’s in this catalogue and on our site are a guide only.
17. Force Majeure
Learning SPACE shall not be liable for failure to perform or delay in performing any of their contractual obligations when this is caused by circumstances beyond their reasonable control.
